These Terms and Conditions (the "Terms and Conditions" or "Terms") govern your access to and use of https://bemdrn.com and https://www.bemdrn.com (along with associated domains operated by MDRN DOC LLC, including www.mdrn-health.com, www.mdrndoc.com, www.trymdrn.com, and www.mdrnscience.com, collectively the "Site"), our secure patient/provider portal, our SMS/text messaging programs, and the telehealth coordination, laboratory assessment, coaching, and personalized wellness services made available through the Site (collectively, the "Services"). This Site is owned and operated by MDRN DOC LLC, doing business as MDRN Health and MDRN Doc ("MDRN," "MDRN DOC LLC," "Company," "we," "us," or "our").
By accessing or using this Site or our Services, you indicate that you have read, understand, and agree to be bound by these Terms and Conditions and our Privacy Policy & Notice of Privacy Practices (available at https://bemdrn.com/privacy-policy) at all times. If you do not agree to these Terms and Conditions, do not access or use the Site or Services.
THESE TERMS AND CONDITIONS CONTAIN AN IMPORTANT MEDICAL EMERGENCY DISCLAIMER (SECTION 2), TELEHEALTH INFORMED CONSENT DISCLOSURES (SECTION 4), SMS/TEXT MESSAGING TERMS (SECTION 8), AND A BINDING ARBITRATION / DISPUTE RESOLUTION CLAUSE (SECTION 14) THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ THEM CAREFULLY.
1. Nature of Our Platform & Independent Medical Practice Disclaimer (LegitScript Compliance)
MDRN DOC LLC operates a cash-pay healthcare, telehealth coordination, and wellness technology platform. MDRN DOC LLC does not itself practice medicine, does not operate as a pharmacy, does not manufacture or compound medications, and does not control or interfere with the independent clinical judgment of any healthcare professional.
- Independent Licensed Healthcare Providers: All medical evaluations, clinical consultations, laboratory interpretations, diagnoses, treatment plans, and prescription decisions are performed exclusively by independent, licensed physicians, nurse practitioners, or physician assistants ("Providers") who hold active licenses in good standing in the patient's state of residence (affiliated through our LegitScript-certified telehealth provider networks, including ConnectMeds and Embed).
- No Guarantee of Prescription or Treatment: Completing a medical intake questionnaire, scheduling or completing a telehealth consultation, or submitting payment does not guarantee that a Provider will write a prescription or recommend any specific medication or treatment. Prescriptions are issued solely when an affiliated licensed Provider determines, in their independent clinical judgment following an appropriate medical evaluation, that prescription treatment is safe and medically appropriate for you.
- No Guarantee of Results: MDRN DOC LLC and affiliated Providers do not guarantee any particular treatment, medication, health outcome, weight-loss result, or improvement in symptoms. Individual results vary based on adherence, physiology, medical history, and lifestyle factors.
2. Medical Emergency Disclaimer
MDRN IS NOT AN EMERGENCY MEDICAL SERVICE AND DOES NOT PROVIDE ACUTE OR EMERGENCY CARE.
IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY—INCLUDING BUT NOT LIMITED TO CHEST PAIN, SHORTNESS OF BREATH, SEVERE ALLERGIC REACTION (ANAPHYLAXIS), SEVERE ABDOMINAL PAIN, SUICIDAL OR HOMICIDAL THOUGHTS, OR ANY OTHER LIFE-THREATENING SYMPTOM—CALL 911 OR PROCEED TO THE NEAREST HOSPITAL EMERGENCY ROOM IMMEDIATELY. Do not rely on the Site, the patient portal, email, or SMS/text messaging for urgent or emergency medical needs.
3. Eligibility, Service Area & Excluded States (35 States & D.C.)
To access or use our Site and Services, you must meet all of the following eligibility requirements:
- Age Requirement (18+ Only): You must be at least eighteen (18) years of age or older and have the legal capacity to enter into a binding contract. Our Site, telehealth evaluations, and SMS messaging programs are strictly intended for adults aged 18 and older.
- Authorized Jurisdictions & Excluded States: MDRN healthcare services and prescription fulfillment are available only in jurisdictions where both the evaluating affiliated Provider and the dispensing partner pharmacy hold active licensure in good standing and where the requested service or treatment is legally permitted. Currently, Services are available in thirty-five (35) U.S. states and Washington, D.C. (AL, AZ, AR, CA, CO, DE, DC, FL, GA, HI, IN, IA, KY, LA, ME, MD, MI, MN, MS, MO, NE, NV, NJ, NY, ND, OH, PA, RI, SC, SD, TN, TX, UT, VA, WI, and WY). Services are NOT currently available to residents of, or individuals physically located in, Alaska (AK), Connecticut (CT), Idaho (ID), Illinois (IL), Kansas (KS), Massachusetts (MA), Montana (MT), New Hampshire (NH), New Mexico (NM), North Carolina (NC), Oklahoma (OK), Oregon (OR), Vermont (VT), Washington (WA), or West Virginia (WV).
- Truthful Location & Identity Verification: You agree to accurately report your physical location at the time of each telehealth consultation and provide valid government-issued photo identification where required by state telemedicine laws.
4. Telehealth Informed Consent, Visit Modalities & Patient Responsibilities
By requesting or participating in a telehealth evaluation through MDRN, you acknowledge and agree to the following:
- Telehealth Modalities (Synchronous & Asynchronous Care): Depending on the telemedicine laws and clinical standard of care in your state of residence, your clinical evaluation may be conducted via synchronous audio-video consultation, synchronous telephone consultation, and/or asynchronous store-and-forward clinical review of your comprehensive medical intake questionnaire, health history, and laboratory data. In states that mandate a synchronous real-time visit to establish a practitioner-patient relationship or qualify for a prescription, a synchronous consultation is required.
- Complete and Accurate Medical Information: Safe clinical care requires complete honesty. You agree to provide truthful, accurate, current, and complete information regarding your medical history, personal or family history of conditions (including medullary thyroid carcinoma or Multiple Endocrine Neoplasia syndrome type 2), current and past medications, allergies, pregnancy or breastfeeding status, and symptoms, and to promptly update your Provider through the secure patient portal if your health status changes.
- Risks and Limitations of Telehealth: While telehealth expands access to licensed clinicians, it has inherent limitations compared to an in-person physical examination, including the inability of the Provider to perform hands-on physical palpation or immediate in-office diagnostic testing, and the potential for rare technical failures despite encryption safeguards. Telehealth is not a substitute for an in-person primary care physician.
5. Pharmacy Fulfillment, 503A Compounded Medications & Safety Disclosures
- Independent State-Licensed 503A Dispensing Pharmacies: MDRN DOC LLC is not a pharmacy and does not dispense, compound, or ship prescription medications. When an affiliated licensed Provider determines a prescription is clinically appropriate, the Provider transmits a patient-specific prescription directly to a state-licensed, LegitScript-certified 503A dispensing pharmacy (including RxRoute, Greenwich, and BelieveRx in Texas, CraftedRx in Missouri, and ChemistryRx in Pennsylvania) that holds active pharmacy licensure in good standing in the state where shipment occurs. MDRN DOC LLC does not dispense, distribute, or administer controlled substances or 503B outsourcing facility products.
- Compounded Medication Disclosure: Certain treatment plans may involve patient-specific compounded prescription medications (such as compounded GLP-1 formulations) when determined clinically appropriate by your licensed Provider. Compounded medications are prepared by licensed 503A compounding pharmacies pursuant to a valid prescription for an individual patient in accordance with applicable federal and state law. Compounded medications are not FDA-approved. The U.S. Food and Drug Administration (FDA) does not review compounded medications for safety, effectiveness, or quality before they are marketed. Availability of particular medications varies based on clinical appropriateness, pharmacy availability, applicable law, and the patient's state of residence.
- Important Safety & Adverse Event Reporting (FDA MedWatch): Prescription medications carry potential risks, contraindications, and side effects. Medications in the GLP-1 receptor agonist class are contraindicated in patients with a personal or family history of medullary thyroid carcinoma (MTC), in patients with Multiple Endocrine Neoplasia syndrome type 2 (MEN 2), and during pregnancy or breastfeeding. Reported serious risks include pancreatitis, gallbladder disease, acute kidney injury, hypoglycemia (particularly with insulin or sulfonylureas), diabetic retinopathy complications, and serious hypersensitivity reactions. Always review the full prescribing and patient medication information provided by your clinician and dispensing pharmacy. Report any side effects or adverse events to your clinician immediately; you may also report side effects directly to the FDA at 1-800-FDA-1088 or online at www.fda.gov/medwatch.
6. Cash-Pay Pricing, Billing, Refunds & SSL/TLS Transaction Security
- Cash-Pay Model (No Insurance Billing): MDRN operates a transparent cash-pay healthcare model. Neither MDRN DOC LLC nor affiliated Providers submit claims to Medicare, Medicaid, Tricare, or commercial health insurance plans. You agree not to submit any services or prescriptions obtained through MDRN for reimbursement to any federal or state healthcare program.
- Consultation, Program & Fulfillment Fees: By providing a payment method (credit or debit card), you authorize MDRN DOC LLC and its PCI-DSS compliant payment processors to charge the disclosed fees for your selected consultation, laboratory panel, coaching program, or prescription coordination.
- SSL/TLS Encryption: In compliance with LegitScript Certification Standard 6 and Terms and Conditions Section VI(f), all financial transactions, payment card details, customer/patient identifiers, medical information, and confidential data transmitted through our Site and checkout flows are protected using industry-standard Secure Socket Layer (SSL) / Transport Layer Security (TLS 1.2/1.3) encryption.
- Refund & Cancellation Policy: Because state and federal pharmacy regulations strictly prohibit pharmacies from accepting returns of or restocking prescription medications once they have been dispensed and shipped to a patient, all dispensed prescription medication orders are final and non-refundable. If a licensed Provider determines during your initial evaluation that you are not clinically eligible for prescription treatment before any medication is dispensed, please contact support at [email protected] or +1 (727) 297-2061 regarding applicable consultation or program refund eligibility.
7. Secure Patient Portal, Account Credentials & Privacy / HIPAA Compliance
- Patient Portal Access & Multi-Factor Authentication (MFA): Patients access clinical intakes, provider communications, and health records through a secure, sign-in patient/provider portal protected by multi-factor authentication (MFA) and HIPAA-compliant encrypted database storage. You are responsible for maintaining the confidentiality of your account login credentials and for all activity occurring under your account.
- Privacy Policy & Notice of Privacy Practices: Your use of our Site and Services is governed by our Privacy Policy & Notice of Privacy Practices at https://bemdrn.com/privacy-policy, which is incorporated into these Terms by reference and details how MDRN DOC LLC complies with HIPAA, the HITECH Act, LegitScript Standard 6 (Privacy), and applicable state medical and consumer privacy laws across all jurisdictions served.

14. Dispute Resolution
Subject to any exceptions specified in these Terms and Conditions, if you and MDRN DOC LLC are unable to resolve any dispute through informal discussion, then you and MDRN DOC LLC agree to submit the issue before a neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA) or a mutually agreed neutral arbitration forum.
